Dentist responsible for problems from "unfinished" root canal?

I just found out that a root canal I had done 9 years ago was not properly finished, the root wasn't filled all the way, it had been completed in 1 visit instead of the usual 2 visits. Now I have pain and might need retreatment, should the original dentist be held responsible? I mean, all other dentists that took x-rays over the years have said the same thing: "this root canal was not properly done". But my original dentist never commented on it, and I never said anything either because I didn't have any pain until now. I read that retreatment is complicated when crowns are involved, I may need to replace that, too. I am really upset. Hope you have some helpful information for me. Thanks.
